  8. Risks inherent in attending Fly-Fishing Events

    Fly Fishing events organized or sanctioned by Fly Fishing Canada, including without limitation national and regional fly fishing championships and conservation symposiums and clinics (each an “FFC Event”) take place in a natural environment - fly fishing and related travel involve risks, dangers and hazards resulting from many different circumstances, including but not limited to: water current, dangerous wading or boating conditions, errant fly casts, collision with natural objects, changing weather conditions, equipment faults and other circumstances not referred to herein but inherent in the hazards which may be encountered in such environments. By registering to participate in an FFC Event, you: (i) understand and accept the foregoing risks, which may cause or result in, without limitation, personal injury or death and damage to or loss of property; (ii) confirm that you do not have any physical, mental or other condition or disability that would create a hazard for you at the FFC Event; rather, you confirm that you are in good physical condition with no recurrent problems that could be aggravated by my participation in the FFC Event; (iii) assume responsibility for, and the risk of, personal injury, death or property damage or loss, as well as any rescue or other costs that may be incurred, resulting from or arising in connection with any participation in the FFC Event; and (iv) on behalf of yourself and your heirs, next of kin, executors, representatives, administrators and assigns, hold harmless and indemnify Fly Fishing Canada and all of its officers, directors, employees, workers, servants and agents and volunteers from any and all liability for any loss, costs, damage, personal injury, death, or expenses sustained by me or any third party which in any way arises out of, or relates to my participation in the FFC Event, however caused, natural or otherwise, other than by the gross negligence or wilful misconduct of Fly Fishing Canada.

  9. Third Party Sites and Products

    Fly Fishing Canada may provide links to various third party websites solely as a convenience for our users and these terms DO NOT apply to such sites. These sites are not under Fly Fishing Canada’s control or direction and Fly Fishing Canada has not reviewed them. Fly Fishing Canada does not endorse or sponsor, and is not responsible or liable for, the contents, products or services available at any such linked site or the practices of these websites (including without limitation, their privacy and data gathering policies and practices). You assume all risk of use thereof.

    From time to time Fly Fishing Canada may offer third party products and services for purchase by users. These products and services are subject to the policies, representations and warranties that those third parties generally provide to their customers with respect to such products and services and Fly Fishing Canada provides no representations or warranties whatsoever regarding them.

    Fly Fishing Canada attempts to be as accurate as possible. However, Fly Fishing Canada does not warrant that event or product descriptions or Content of this site is accurate, complete, reliable, current, or error-free.

    Fly Fishing Canada reserves the right to change these Terms at its sole discretion and without notice.     Fly Fishing Canada controls the Website (excluding third party linked sites) from its corporate offices within the province of Ontario, Canada. By visiting the Website, you agree that the laws of the Province of Ontario, Canada, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and Fly Fishing Canada. Choice of law principles and the United Nations Convention for the International Sale of Goods and any legislation implementing such Convention are hereby expressly excluded. Fly Fishing Canada makes no representation that the Website or Content are appropriate or available for use in other locations. Accessing the Website or Content from jurisdictions where they are illegal is prohibited.     The limited warranty, exclusive remedies and limited liability set out herein are fundamental elements of the basis of the bargain between us. We would not be able to provide the website or its associated products or services on an economic basis without such limitations.
